The Mirren Talent Terms and Conditions (Agreement) describe the terms by which you may participate in the online services provided by Mirren Talent, as owned and operated by Mirren Business Development LLC (“Mirren”).
Professional recruiters are not permitted to use Mirren Talent in any manner whatsoever. Should a marketing services firm provide access to a recruiter, they risk being permanently banned from this service.
Mirren Talent is only for the use of marketing services agencies ("Agencies") who are conducting a new business executive search and for new business executives that include executives in new business, sales and marketing, and those interested in the role of new business ("New Business Executives"). Mirren Talent is not available to minors under the age of 18, or to any agency subscriber or new business executive suspended or removed from the system by Mirren for any reason. Mirren Talent agency subscribers and new business executives may not have more than one active account. Additionally, subscribers are prohibited from selling, trading, or otherwise transferring their Mirren Talent account to another party. Based on the above, if you do not qualify, you may not use Mirren Talent.
You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your password or account with or without your knowledge.
For Agencies, each login is tied to a specific machine registered for the service for security reasons. Given the volume of personal and confidential information in our system, all logins are tied to an individual machine. This guards from having logins widely distributed and exposing sensitive new business executive information. New business executives are agreeing to provide a large amount of personal information on the condition that their identity is protected until they decide to reveal it to an agency. To that end, to protect from agency login information being shared broadly and indiscriminately this is controlled by tying each login to a machine and limiting up to two logins per account. Without these safeguards, we would have a much smaller pool of new business executives. If you provide your login information to another person, your account privileges may be suspended temporarily or terminated. You agree to immediately notify Mirren of any unauthorized use of your password or account or any other breach of security. Mirren does not accept any responsibility for the security of your computer and others that may access your account due to lack of proper security measures. Mirren cannot and will not be liable for any loss or damage arising from your failure to comply with this policy.
For new business executives, Mirren Talent is not responsible for any errors made in the profile information you have entered and whether or not any Public/Private settings are correct, which then may reveal personally identifiable information. By using this service, you agree to take full responsibility as a new business executive managing your own profile. You acknowledge and agree that you are solely responsible for the form, content, and accuracy of any resume or material contained therein placed by you. If you are concerned about your privacy beyond the measures put in place by Mirren, then do not use this service.
Given Mirren’s extensive access to the new business community, on occasion the Mirren Talent team identifies strong talent that would be worthy of being notified of new career opportunities. In these situations, the Mirren Talent team may assist the new business executive and start a profile for them based on publicly available information, such as on LinkedIn and information on agency websites. In these cases your personal information is still not revealed and new business executives will be immediately notified, providing them the option to delete their profile and thereby opt out of being in the loop for new opportunities. We assume no responsibility for incorrect information we have collected from public resources.
Disclaimer of Warranty
TO THE FULLEST EXTENT POSSIBLE BY LAW, MIRREN TALENT DOES NOT WARRANT THAT ANY MIRREN SITE OR ANY MIRREN SERVICES WILL OPERATE ERROR-FREE OR THAT ANY MIRREN SITE AND ITS SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF ANY MIRREN SITE OR THE MIRREN CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA OR ANY OTHER COSTS, MIRREN IS NOT RESPONSIBLE FOR THOSE COSTS. THE MIRREN SITES AND MIRREN CONTENT ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. MIRREN, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT. MIRREN MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE MIRREN CONTENT, SERVICES, SOFTWARE, TEXT, GRAPHICS, AND LINKS.
Disclaimer of Consequential Damages
TO THE FULLEST EXTENT POSSIBLE BY LAW, IN NO EVENT SHALL MIRREN, ITS SUPPLIERS, OR ANY THIRD PARTIES MENTIONED ON ANY MIRREN SITE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST EMPLOYMENT OPPORTUNITY OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE ANY MIRREN SITE AND THE MIRREN CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT MIRREN IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Limitation of Liability
TO THE FULLEST EXTENT POSSIBLE BY LAW, MIRREN’S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH ANY MIRREN SITE OR YOUR USE OF THE MIRREN CONTENT, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE), WILL NOT EXCEED $100.
These Terms are governed by the internal substantive laws of the State of Washington, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts within Seattle, Washington. If any provision of these Terms are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. In addition, Mirren’s failure to enforce any term of these Terms shall not be deemed as a waiver of such term or otherwise affect Mirren’s ability to enforce such term at any point in the future. Except as expressly provided in an additional agreement, additional Terms for certain areas of the Mirren Sites, a particular "Legal Notice," or software license or material on particular pages on the Mirren Sites, these Terms constitute the entire agreement between You and Mirren with respect to the use of the Mirren Sites. No changes to these Terms shall be made except by a revised posting on this page.
Your use of Mirren Talent is governed by these Terms and Conditions. Mirren Talent may refuse service without prior notice to any user for any or no reason.
Mirren Talent (including Mirren.com), the Mirren Talent logo, and other Mirren names, including, but not limited to, Mirren Business Development are trademarks of Mirren. You agree not to display or use these trademarks in any manner without Mirren’s prior written permission. The section titles of this Terms and Conditions are displayed for convenience only and have no legal effect.
